The Justice Department charged the woman who spat in the face of DOJ Pardon Attorney Ed Martin during a live Newsmax interview with a federal crime on Thursday.
The woman, identified as 32-year-old Emily Gabriella Sommer, faces one count of assaulting a federal officer under 18 U.S.C. § 111, following the shocking incident that unfolded in broad daylight.
The self-proclaimed "leftist" from the District of Columbia assaulted Martin on May 8 at approximately 3:30 p.m. outside the U.S. Attorney’s Office on the 600 block of D Street Northwest.

Martin was speaking on camera when Sommer approached, shouting profanities and demanding, "Who in the f– are you?"
After confirming Martin’s identity, she lunged forward, spitting on his shoulder, then walked away with her dog while yelling, "You are a disgusting man. F— you, Ed Martin. My name is Emily Gabriella Sommer, and you are served!"
The confrontation was captured on video.

Sommer didn’t stop at the assault. She later boasted about committing the crime on X under the handle lefttits@EmilyGabriellaS, as if she were some kind of hero.
"ED, that was me that spit in your face today... A pleasure to hawk a dehydrated, pithy white foam spit into your face."
In a second post, she hurled insults, calling Martin a "disgusting pig-headed swine blooded white privileged racist, misogynist, and nepotism hire," adding, "Bye, enjoy that spit on your $6k lapel, your other white bitch CRACKER."

Martin’s nomination for the permanent U.S. Attorney role was withdrawn by President Trump on the same day as the incident, with Jeanine Pirro stepping in amid Martin’s controversial tenure and bipartisan Senate opposition tied to his defense of January 6 defendants.

Law enforcement arrested Sommer on Thursday, following an investigation by the U.S. Marshals Service.

The case, announced by U.S. Attorney Jeanine Ferris Pirro and Acting U.S. Marshal Ron Carter, is being prosecuted by Assistant U.S. Attorney Jacob Green.
Sommer could face up to 8 years in prison and a possible fine for violating 18 U.S.C. § 111 for assaulting, resisting, or impeding a federal officer, though actual sentencing depends on factors like her criminal history, the judge’s discretion, and any plea deals.
